Examination of the Revised Local Plan and CIL Charging Schedule

The Legacy Corporation submitted its Draft Revised Local Plan and revised CIL Draft Charging Schedule for Examination on 8 March 2019, having prepared its Draft Revised Local Plan under the Town and County Planning (Local Planning) (England) Regulations 2012. It has also prepared its revised Draft CIL Charging Schedule under the Community Infrastructure Levy Regulations 2010 (as amended). Consultation on the Draft Revised Local Plan and Preliminary Draft Revised CIL Charging Schedule took place between 5 November and 17 December 2018 and on the Draft Revised CIL Charging Schedule between 14 January and 15 February 2019.
Copies of the Local Plan, Policies Map, sustainability appraisal and consultation report alongside all other supporting documentation, and the CIL Draft Charging Schedule along with its supporting documentation were made available to be viewed at the Legacy Corporation’s office during the entire review process.

An independent examiner, Mike Fox, was appointed by the Secretary of State to undertake the Examination of the Draft Revised Local Plan and also the draft revised CIL Charging Schedule and to subsequently issue a report with his conclusions. The Legacy Corporation received the Inspector's reports on the Examination of the revised Local Plan and the revised CIL Charging Schedule on 24 April 2020. The next step is for the Legacy Corporation Board to consider whether to adopt the Local Plan with the inclusion of the main modifications recommended by the Inspector. Chris Banks fulfilled the role of Programme Officer. Now that the Inspector’s report has been issued the duties of the Programme Officer have ended; no further correspondence should be submitted for the attention of the Inspector. Future enquiries regarding the Local Plan should be directed to the LLDC Plannign Policy Team.
Examination Hearings
Examination Hearings took place between 17 – 20 September 2019. The inspector issued separate guidance notes for the Examination of the Revised Local Plan and that for the Community Infrastructure Levy which are accompanied by a Matters, Issues and Questions note. Consultation of Main Modifications following the Examinations Hearings
Following the Examination Hearings into the draft Revised Local Plan, the Inspector issued the proposed draft Main Modifications to the Plan for consultation. The consultation was held for six weeks between 13th January and 24th February 2020. Representations were invited on the Main Modifications contained in Document ID/5 to which a link is provided below. This is accompanied by Document ID5A - Integrated Impact Assessment (IIA) and Appropriate Assessment (AA) Addendum of the draft Revised Local Plan to which a link is also provided.

Comments received to the modifications consultation
The Legacy Corporation received 42 separate responses to the modifications consultation. The main modification comments were forwarded to the Inspector for consideration in drafting his report. The other minor modification responses will be a matter for consideration by the Legacy Corporation on adoption.
